📋 AGL Sales Pty Ltd: Paid $924,600 in penalties for raising prices for 15,845 residential and small business customers by increasing gas and electricity tariffs on days that were not designated tariff change dates between July 2020 and June 2023, charging customers more than the law allowed on 49,394 occasions to a combined value of $924,107 (Energy Retail Code of Practice price certainty obligations). ⚖️ AGL Retail Energy Limited and three other AGL Energy subsidiaries: Federal Court ordered penalties totalling $25 million — the largest ever imposed for breaches of the National Energy Laws — for failing to comply with overcharging obligations related to Centrepay payments. The Court found AGL overcharged 483 Centrepay customers between 9 January 2017 and 28 October 2021 and committed 16,156 breaches by failing to inform and refund customers within the required timeframes (penalty judgment, Justice Downes, 19 December 2024). The Court also ordered three subsidiaries to establish and maintain a compliance program for 3 years. NOTE: These December 2024 orders were set aside on appeal — the Full Federal Court allowed AGL's appeal on 19 August 2026 ([2026] FCAFC 106), finding no contravention of rule 31 or section 273(1); the AER was ordered to repay the $25 million penalty with interest and pay AGL's costs.
