📝 Dodo (M2 Energy Pty Ltd): AER accepted a court enforceable undertaking in which Dodo admitted breaching rules 71(1) and 72(1)(a) of the National Energy Retail Rules (failing to inform three hardship customers of its hardship policy and failing to have regard to three customers' capacity to pay when establishing payment plans). Dodo must appoint an independent expert to review its hardship policy and compliance, establish a compliance and training program, refund direct debit fees from unauthorised attempts affecting hardship customers (8 Oct 2022 to 8 Oct 2024), and refrain from charging hardship customers direct debit decline fees for two years.

📋 M2 Energy Pty Ltd trading as Dodo Power & Gas: Paid $82,500 after the ACCC issued six infringement notices for alleged contraventions of the Electricity Retail Code. Dodo admitted that between 1 July 2022 and 31 May 2023 the standing offer prices for two of its offers exceeded the regulated price cap, that price change communications sent on 6 and 20 June 2023 omitted required information, and that it did not record how some offered prices were calculated. Dodo also gave the ACCC an enforceable undertaking admitting the contraventions. The ACCC's first enforcement action on the standing offer price cap.
